(A) Appointment.
(1) The Board of Trustees shall appoint a Village Manager who shall be the administrative head of the Village and who shall be responsible for the efficient administration of all departments. The Village Manager shall be appointed without regard to their political beliefs but solely on their fitness for the position. The Village Manager, or their designee, shall serve as the Personnel Officer for the Village of Maywood.
(2) The Village Manager need not be a resident of the Village when appointed but during their tenure of office they shall reside within the corporate boundaries of the Village or within a 15-mile radius of the corporate boundaries of the Village. During the absence, disability, or during such period of time that the Village Board is seeking a qualified person to fill the office of Manager, the Board may designate some properly qualified person to act as Village Manager pro tempore and to perform the duties of that office.
(B) Term of office. The term of office of the Village Manager shall be indefinite but they may be removed at any time by a majority vote of the Board.
(C) Bond. Before entering upon the duties of their office, the Village Manager shall execute an oath of office and shall furnish a surety bond in such amount and form as is approved by the Board, such bond to be conditioned upon the faithful performance of their duties. The premium of the bond shall be paid by the Village.
(D) Compensation. The Village Manager shall receive such compensation as the Board shall fix from time to time by ordinance.
(E) Powers and duties. The Village Manager shall be the chief administrative officer of the Village. They shall be responsible to the Board for the proper administration of all affairs of the Village. As such administrative officer, they shall have the management and control of all matters and things pertaining to the operation and maintenance of the properties of the Village and of all departments of the Village, including the Department of Public Works, the Fire Department, the Police Department, the Community Development Department, the Building and Code Enforcement Department, and the Department of Finance and the general offices of the Village. They shall also have supervision of such other agencies, departments and offices as may be created by the Board, unless the management and control of such departments and offices is expressly delegated elsewhere. Specifically, but not in limitation of the above, they shall have the following additional powers and duties:
(1) To enforce the laws and ordinances within the Village;
(2) To appoint, suspend or remove all department heads. Such appointments, suspensions or removals shall be based upon merit and fitness and shall be without regard to political belief or affiliation;
(3) To exercise control and authority over all departments and divisions thereof now in existence or that may hereafter be created by the Board except as may be specifically limited or restricted by ordinance;
(4) Make recommendations to the Board concerning compensation for each appointive office and position in the Village, including minimum, intermediate and maximum rates, except that for the appointed office of Deputy Clerk, the Village Clerk shall make such recommendations;
(5) Recommend to the Board the creating, consolidating and combining of officers, positions, departments or units of the administrative and executive departments of the Village;
(6) Investigate all complaints in relation to matters concerning the administration of the government of the Village and services maintained by the public utilities in the Village, and they shall see that all franchises, permits and privileges granted by the Village are faithfully observed;
(7) The Village Manager shall sign on behalf of the Village any contract authorized by the Board, except where the Board or statutes of the state directs that some other officer shall do so. It shall be the duty of the Village Manager to see that all terms of any contract to which the Village is a party are fully performed by all parties thereto;
(8) Keep a current inventory of all real and personal property of the Village and location of such property. They shall be responsible for the care and custody of all Village property which is not by law assigned to some other officer or body for care and control;
(9) Attend all meetings of the Board. They shall have the right to take part in the discussion of all matters coming before the Board, but shall have no right to vote. They shall be entitled to notice of all special and regular meetings of the Board;
(10) Recommend to the Board such measures as in their judgment he deems to be in the best interest of the Village;
(11) Devote their entire time to the discharge of his official duties;
(12) They shall have the power to issue on behalf of the Village all licenses and permits where not otherwise specifically delegated to other authority by ordinance;
(13) They shall have the power to appoint and to discharge any employee of the Village, except those under civil service. Upon discharging any employee, they shall submit at the next Board meeting following such removal a statement concerning the removal and the reasons therefor;
(14) In their sole discretion and where deemed necessary or advisable in order to facilitate the conveyance of real estate where such conveyance is in the best interests of the Village, to approve a reduction in the dollar amount or waive the dollar amount and execute releases of Village liens filed against real estate of up to a cumulative total of $25,000 per real estate transaction;
(15) To perform such other duties as may be required of them by the Board consistent with the Village ordinances and the statutes of the state.
(F) Compensation. The initial salary of the Village Manager shall be established by the Board based upon and up to the amounts duly appropriated for that position by the appropriation ordinance now in effect, or as may otherwise be provided by ordinance.
(G) Dealings of elected officials with administration. Except for the purpose of inquiry, the elected officials of the Village shall deal with the administrative service only through the Village Manager, and such officials shall not give orders to any subordinates of the Village Manager, either publicly or privately.
