§ 95.04 HOME KITCHEN OPERATION.
   Home kitchen operations are authorized in the Village, subject to the following requirements:
   (A)   Home kitchen operations shall obtain and maintain a Village-issued business license pursuant to § 110.01 (Licenses Required) of the Village Code.
   (B)   Home kitchen operations shall submit a written disclosure to the Village yearly, on or before each May 1, including a Federal Employer Identification Number, a copy of a current Food Protection Manager Certification from the Illinois Department of Public Health and such other information and materials as the Health Officer may require.
   (C)   Home kitchen operations shall comply with the following requirements:
      (1)   Packaging or production shall be limited to non-potentially hazardous baked goods, as defined in 410 ILCS 625/4(a), as amended from time to time, which shall occur in a kitchen of a primary domestic residence for direct sale by the owner or a family member.
      (2)   Non-potentially hazardous baked goods include goods such as, but not limited to, breads, cookies, cakes, pies and pastries are allowed. Only high-acid fruit pies that use the following fruits are allowed: apple, apricot, grape, peach, plum, quince, orange, nectarine, tangerine, blackberry, raspberry, blueberry, boysenberry, cherry, cranberry, strawberry, red currants or a combination of these fruits.
      (3)   Monthly gross sales shall not exceed $1,000.
      (4)   A notice shall be provided to the purchaser that the product was produced in a home kitchen.
      (5)   The food package shall be affixed with a label or other written notice provided to the purchaser that includes:
         (a)   The common or usual name of the food product; and
         (b)   Allergen labeling as specified in federal labeling requirements by the United States Food and Drug Administration.
      (6)   The food shall be sold directly to the consumer.
      (7)   The food shall be stored in the residence where it is produced or packaged.
      (8)   A Food Protection Manager Certification from the Illinois Department of Public Health shall be maintained.
      (9)   Additional requirements, if any, from 410 ILCS 625/3.6. as amended from time to time.
   (D)   Upon receipt of a complaint regarding a home kitchen operation, the Health Officer shall make or cause to have made an inspection of a home kitchen operation. Other inspections, surveys, investigations and studies of home kitchen operations shall be performed by the Health Officer as may be necessary to determine that home kitchen operations are constructed, operated and maintained in compliance with the standards and requirements set forth herein.
   (E)   Section 12 (On-Site Development Standards), Subsection 12.4 (Accessory Structures and Uses), Subsection F (Home Occupations) of the Maywood Village Zoning Code applies to home kitchen operations.
