§ 128.04 VACATION RENTAL LICENSE ISSUANCE AND RENEWAL: PROHIBITIONS.
   (A)   No business license to engage in vacation rental shall be issued to:
      (1)   Any applicant, if such applicant or any other person with an ownership interest in the property on which the vacation rental is located, including co-owners, partners, members, managers, or officers of any owning partnership, limited liability company or corporation, has ever been convicted in any jurisdiction of any felony that is rationally related to the individual's fitness or capacity to operate a vacation rental.
      (2)   Any applicant whose license to operate a vacation rental or similar establishment at any location within or outside the village has been revoked for cause within the last three years.
      (3)   Any applicant where the applicant or any other person with an ownership interest in the property on which the vacation rental is located, including co-owners, partners, members, managers, or officers of any owning partnership, limited liability company or corporation, is in default to the village regarding payment of water and sewer charges, special taxes or assessments, parking and other village violation citations or judgments, motor vehicle tax, or any other license, taxes or fees that are due and unpaid by such person to the village or where there are delinquent property taxes owed to Cook County on the property on which the vacation rental is located, or any other property owned within the village by the applicant or co-owners, partners, members, managers, or officers of any owning partnership, limited liability company or corporation.
   (B)   Vacation rental licenses shall be continually monitored By village staff and renewal of a vacation rental license shall not be construed as a vested right which shall in any case prohibit the village from declining to renew a license in a subsequent year. Circumstances that may affect a license renewal include, but are not limited to:
      (1)   Any change in the ownership interest in the vacation rental during the previous year:
      (2)   Any police reports filed relative to the vacation rental property, and the general circumstances of the incident resulting in each report;
      (3)   Any citizen complaints filed against any vacation rental property, and the general nature of each complaint;
      (4)   Any disciplinary action taken against a vacation rental licensee and any reasons therefore; and
      (5)   Any other information that village staff determines is relevant relative to a vacation rental.
   (C)   Reasonable conditions may be placed on a license or renewal by the Finance Director, after input from the Community Development Director.
