§ 51.59 INSPECTION OF WATER SERVICE PIPES; DUTY OF PROPERTY OWNER TO MAINTAIN WATER PIPES.
   (A)   All water service pipes and connections shall be inspected and approved by the Director of Public Works or other persons under his direction, and no such service pipes shall be covered until they have been so inspected.
   (B)    It shall be the duty of every person owning or controlling any property or building to which water pipes have been connected to maintain that portion of the water pipe from the stop cock to the water meter in good working order, free of any leaks. Upon notification from any source, including notification by a Village employee, tenant or through observation that the water pipe from the stop cock to the water meter is either leaking or frozen, the person responsible shall immediately cause the water pipe to be repaired and returned to good operating condition.
   (C)   In the event that the water pipe is not repaired within 48 hours of notice of a defect, the Village shall have the right to shut off in whole or in part the water supply to such property or building. Prior to disconnection of water service for failure to repair the water pipe, the Village Manager shall cause a notice to be delivered to the occupants of the property or building, the person to whom the water bill is directed, and the person who owns or controls the property or building, advising them that a hearing will be held by a hearing officer appointed by the Village Manager on a date, not less than 3 days following the date of the notice, at which time the parties named above may show cause as to why water service for the property or building should not be disconnected for failure to repair the water pipe. The notice shall be entitled “Notice of Hearing as to Whether Water Service Should Be Shut Off for Failure to Repair Water Pipe,” and shall be delivered personally or by certified mail, return receipt requested. In addition, where the premises are a multi-family dwelling, the notice shall be posted in a conspicuous place upon or near the premises. Water service shall not be disconnected to any property or building until after a hearing is held as provided for in this subsection.
