§ 50.45 COMMERCIAL TYPE INCINERATORS.
   (A)   As used in this section, COMMERCIAL TYPE INCINERATOR means an exterior free standing mechanical device for the incineration of wastes, and does not include simple wire baskets, or similar containers wherein wastes may be burned, nor does it include any incinerator located within a building where wastes are loaded therein from inside the building.
   (B)   The installation of any commercial type incinerator within the Village limits shall comply with all Village ordinances relating thereto, and in addition, shall be subject to the provisions of this section.
   (C)   No person shall install or cause to be installed any commercial type incinerator within the Village limits without first having secured a license therefor. No commercial type incinerator installed within the Village limits prior to June 27, 1963 shall be used after said date without a license therefor. After June 27, 1963 no unlicensed commercial type incinerator shall be used within the Village limits. The annual license fee for a commercial type incinerator is $25.
   (D)   Before any commercial type incinerator is approved, the Director of Public Works and the Chief of the Fire Department shall inspect, in operation, the type of incinerator to be installed. The type of incinerator shall be approved if it does not create a nuisance and conforms to all Village ordinances. Every installed commercial type incinerator shall be inspected by the Chief of the Fire Department and Director of Public Works at least twice each year for which the incinerator is licensed. Such licenses shall be revoked whenever the incinerator does not conform to Village ordinances or is operated in violation thereof.
   (E)   Every commercial type incinerator shall stand at least 4 feet from any building and shall be enclosed by a wire chain-link fence at least 5 feet in height, with openings not more than 3 inches wide. Such fence shall be at least 3 feet from the incinerator at all places. The gate to such fence shall be securely locked at all times when the incinerator is not attended. No commercial type incinerator shall be loaded from within any building.
   (F)   No commercial type incinerator shall be used or operated by any person under 18 years of age.
