§ 120.07 CO-LOCATION DESIGN REQUIREMENTS.
   Any proposed wireless communication facility shall be designed, structurally, electrically, and in all respects, to accommodate both the applicant's antennas and comparable antennas for at least 2 additional users if the tower is over 100 feet in height (plus Village antennas and related equipment, as specified in division (E) of this section) or for at least 1 additional user if the tower is over 60 feet in height. Towers must be designed to allow for future rearrangement of antennas upon the tower and to accept antennas mounted at varying heights.
   (A)   The facility shall make available unutilized space for co-location of other communication facilities, including space for these entities providing similar, competing services.
   (B)   A good faith effort in achieving co-location shall be required of the host entity.
      (1)   Requests for utilization of facility space and responses to such requests shall be made in a timely manner, in writing, and copies shall be provided to the Village's business license files.
      (2)   The Plan Commission/Zoning Board of Appeals shall mediate any unresolved disputes pursuant to Section 3.2 of the Zoning Ordinance of the Village of Maywood.
   (C)   The applicant shall provide a notarized letter of intent committing the tower owner and successors to allow the shared use of the tower if an additional user agrees in writing to meet reasonable terms and conditions for shared use.
   (D)   The applicant shall also provide a report from a licensed professional engineer that demonstrates the tower's compliance with co-location structural and electrical standards.
   (E)   An applicant for a tower over 100 feet in height must reserve space on the tower above 100 feet and allow the Village, at its cost, to install, operate and maintain its antennas and equipment for municipal purposes and public health, welfare and safety purposes during the time the tower is operational. This reservation of space is exclusive of the space that must be reserved for an additional 2 users as required in this division.
