(A) If on the date set for hearing the respondent, or his attorney or agent of record, fails to appear, the Hearing Officer shall proceed with the hearing and accept evidence relevant to the issue of liability and may enter a default finding against the respondent as to the existence of a Code violation, impose fines, penalties and assess costs.
(B) A copy of the order of default shall be served in any manner for service of a notice of violation permitted by this chapter and applicable to the violation.
(C) A copy of the order of default or letter accompanying such order shall apprise the respondent of the procedures for setting aside the default decision.
