§ 117.03 LOCAL LIQUOR CONTROL COMMISSION.
   (A)   Created/membership. A Local Liquor Control Commission, having been created by the Local Liquor Control Commissioner, shall consist of the President of the Board of Trustees as the Local Liquor Control Commissioner and 5 other persons as the President shall appoint with the advice and consent of the Board of Trustees. The President’s appointments shall serve for a term of 1 year and shall assist the President in the exercise of the powers and in the performance of their duties that are specified in the state statutes and/or in this section and chapter. Persons appointed to the Local Liquor Commission by the President may be reappointed and may serve a maximum of 3 consecutive 1-year terms. Persons whose membership on the Local Liquor Control Commission ended due to having served 3 consecutive 1-year terms may not be reappointed until at least 1 year has elapsed since the conclusion of their membership on the Commission. Members shall hold office for their designated terms and until their successors have been appointed.
   (B)   Chairman. The Local Liquor Control Commissioner shall act as chairperson for the purpose of presiding over meetings conducted by the Commission.
   (C)   Powers/duties. The Local Liquor Control Commission shall have and exercise the following duties as directed by the Local Liquor Control Commissioner:
      (1)   To review applications and the investigation of applicants for liquor licenses, and to submit findings and recommendations to the Local Liquor Control Commissioner either through an oral vote or by setting forth in writing its conclusions regarding such applications;
      (2)   To keep written records of its meetings and proceedings which shall be open for public inspection in accordance with the Freedom of Information Act; and
      (3)   Such other duties as determined by the Local Liquor Control Commissioner.
   (D)   Joint Commission for Tobacco and Cannabis Regulation and Licensing. The members of the Local Liquor Control Commission shall also serve as the members of the Joint Commission for Tobacco and Cannabis Regulation and Licensing as prescribed under § 129B.01 of this Code and shall have and exercise such duties and powers granted it under the same.
