§ 117.02 LOCAL LIQUOR CONTROL COMMISSIONER.
   (A)   Designation. The President of the Board of Trustees is designated the Local Liquor Control Commissioner, for and on behalf of the Village.
   (B)   Functions; state law adopted. The Local Liquor Control Commissioner shall be charged with the administration of the appropriate provisions of the Illinois Liquor Control Act (235 ILCS 5/1-2 et seq.), which Act is made a part hereof and incorporated by reference with the exception of Articles III, V, VII(A), VIII and IX, and of such ordinances and resolutions relating to alcoholic liquor as may be enacted by the Board of Trustees.
   (C)   Compensation of Liquor Commissioner. Effective June 1, 2009, the Local Liquor Control Commissioner shall receive the sum of $10,000 per year payable in bi-weekly installments for his or her services as Local Liquor Control Commissioner.
   (D)   Powers and duties. The Local Liquor Control Commissioner shall have the following powers, functions, and duties with respect to local liquor licenses:
      (1)   To grant and/or suspend for not more than 30 days or revoke for cause all local licenses issued to persons or entities for premises within the Village if they determine that the licensee has violated any of the provisions of the Illinois Liquor Control Act or of any ordinance or resolution enacted by the Board of Trustees, or any applicable rule or regulation established by the Local Liquor Control Commissioner or the State Commission which is not inconsistent with law;
      (2)   To enter or authorize any law enforcing officer to enter at any time upon any premises licensed hereunder to determine whether any of the provisions of the state law or Village ordinances or any rules or regulations adopted by the Local Liquor Control Commissioner or by the State Commission have been or are being violated, and at such time to examine the premises of the licensee in connection therewith;
      (3)   To notify the Secretary of State where a club incorporated under the General Not For Profit Corporation Act of 1986 (805 ILCS 105/101.01 et. seq.) or a foreign corporation functioning as a club in this state under a certificate of authority issued under that Act has violated the Liquor Control Act of 1934 by selling or offering for sale at retail alcoholic liquors without a retailer’s license;
      (4)   To receive complaints from any citizen within the Village that any of the provisions of the state law or Village ordinances have been or are being violated and to act upon such complaints in the manner provided by law; and
      (5)   To receive local license fees and pay same to the Village Treasurer.
   (E)   Examination of licensees and applicants. The Local Liquor Control Commissioner shall have the right:
      (1)   To examine, or cause to be examined, under oath, any applicant for a local license or for a renewal thereof, or any licensee upon whom notice of revocation or suspension has been served, or anylicensee against whom a citation or other disciplinary or enforcement proceeding has been instituted by the Village, the Local Liquor Control Commissioner or the State of Illinois Liquor Control Commission;
      (2)   To examine, or cause to be examined, the books and records of any such applicant or licensee or respondent;
      (3)   To hear testimony and take proof for their information in the performance of their duties; and for such purposes to issue subpoenas which shall be effective in any part of this state; and
      (4)   To order, upon the issuance of a written order, the licensed premises closed for not more than 7 days, giving the licensee an opportunity to be heard during that period, if the Local Liquor Control Commissioner has reason to believe that any continued operation of a particular licensed premises will immediately threaten the welfare of the community; except that if such licensee shall also be engaged in the conduct of another business or businesses on the licensed premises, such order shall not be applicable to such other business or businesses.
      (5)   For the purposes of obtaining any of the information desired by the Local Liquor Control Commissioner under this section, they may authorize an agent to act on their behalf.
   (F)   Records. The Village Clerk shall keep or cause to be kept a complete record of all licenses issued by the Local Liquor Control Commissioner under this chapter, and shall furnish the Chief of Police and Building Director with a copy. Upon the issuance of any new license, or the revocation of any old license, the Clerk shall give written notice of such action to the Chief of Police and Building Director within 48 hours of being notified by the Local Liquor Control Commissioner of such action. The Village Clerk shall act as custodian of all records for the Local Liquor Control Commissioner and shall keep a record of all proceedings, transactions, communications and official acts of the Commissioner, and shall perform such other duties as they may prescribe.
   (G)   Commissioner of the Joint Commission for Tobacco and Cannabis Regulation and Licensing. The Local Liquor Control Commissioner shall also serve as the Tobacco and Cannabis Commissioner and as chair of the Joint Commission for Tobacco and Cannabis Regulation and Licensing as prescribed under § 129B.02 of this Code and shall have and exercise such duties and powers granted them under the same.
