§ 92.04 SMOKING REGULATIONS.
   (A)   For the purposes of regulating clean indoor air and smoking in the Village, the provisions of the Smoke Free Illinois Act, 410 ILCS 82/1 et seq., as amended, and the regulations of the Illinois Department of Public Health, as amended, along with any applicable regulations under federal law, shall be controlling.
   (B)   Violations:
      (1)   A person, corporation, partnership, association or other entity who violates the Smoke Free Illinois Act shall be fined pursuant to this section. Each day that a violation occurs is a separate violation.
      (2)   A person who smokes in an area where smoking is prohibited under the Smoke Free Illinois Act shall be fined in an amount that is not less than $100 and not more than $250. A person who owns, operates, or otherwise controls a public place or place of employment that violates the Smoke Free Illinois Act shall be fined not less than $250 for the first violation, not less than $500 for the second violation within 1 year after the first violation, and not less than $2,500 for each additional violation within 1 year after the first violation.
      (3)   A fine imposed under this section shall be allocated as follows:
         (a)   One-half of the fine shall be distributed to the Illinois Department of Public Health; and
         (b)   One-half of the fine shall be distributed to the Village.
