Ownership of Pit Bulls, as such dogs are defined in this chapter, shall, in addition to any other requirements imposed by this chapter or state law, be subject to the following requirements:
(A) No owner shall permit a Pit Bull outside of its enclosure unless it is:
(1) Securely muzzled;
(2) On a nonretractable leash or chain with a tensile strength of 300 pounds and not exceeding 3 feet in length; and
(3) Is under the direct control and supervision of the owner, or a family member, 16 years of age or older.
(B) The owner of a Pit Bull shall display Village-approved signage on all entrances to the property. Such sign shall state "Beware of Dog", "Pit Bull Dog", or "Dangerous Dog" and shall be displayed in a conspicuous manner. Such sign shall have lettering that is clearly legible and at least 2 inches in height, and shall be posted in a conspicuous location on the fence enclosing the yard of the residence or gate thereto, or, where a Pit Bull is also kept within the residence, at any entrance doors to the building or residence where the Pit Bull resides.
(C) Prior to obtaining a Village permit for a Pit Bull, an owner shall be required to install an exterior enclosure, as defined in this chapter, and to keep the Pit Bull within the enclosure at all times the animal is on the owner's property but not within the owner's residence.
(D) All gates on fences at residences and enclosures where a Pit Bull is kept or resides shall be equipped with self-closing and self-latching mechanisms designed to securely close and lock the gate.
(E) No Village permit shall be issued for ownership of a Pit Bull over 4 months of age without proof that the Pit Bull has been spayed or neutered.
(F) In addition to permitting requirements set forth elsewhere in this chapter, no Village permit shall be issued for ownership of a Pit Bull without the submission of proof by the owner that:
(1) The Pit Bull has received obedience training from a certified, licensed trainer in the past calendar year and has passed the obedience test related to said training; and
(2) The owner has a current homeowners or renter's insurance policy covering the address where the Pit Bull is kept or resides.
(G) No Village permit shall be issued for ownership of a Pit Bull to a tenant without a signed consent from the landlord indicating that the Pit Bull is allowed to reside on the premises. The tenant shall have to comply with the enclosure provision and each of the other provisions set forth in this chapter.
(H) No Village permit shall be issued for ownership of a Pit Bull for a residence that is within 1,500 feet of a school, public park, playground, day care facility, or other similar facility. This division shall not apply to Pit Bulls who resided at such a residence prior to the effective date of this amendatory ordinance of 2006 and for whom valid Village permits evidencing such residency had previously been obtained.
