1371.01 APPLICATION FOR PERMIT.
Any person, firm or corporation desiring to remove top soil, loam, sand, gravel or other substances from land located in any area within the Municipality, for sale and subject to the exceptions listed in Section 1371.06, for activities incidental to work or construction authorized under a building permit, shall first file with the Building Commissioner, a written application for a permit to carry on such operations, which shall contain the following information, together with such other in formation as may be required by the Municipal Engineer or Building Commissioner:
(a) Name and Address of Applicant. If the applicant is a partnership, the name and address of each of the partners shall be stated and, if the applicant is a corporation, the names and addresses of its principal officers shall be listed. If the applicant is not the owner of the land described, then the name and address of the owner must be stated and the owner’s written consent to the work proposed must be attached to the application.
(b) A description of the land on which the operations are to be take place.
(c) The method of stripping and removal to be employed.
(d) The time within which the work will be commenced and completed.
(f) The type of reseeding or replanting proposed for the land.
(g) A maintenance of traffic plan, including trucking route and traffic control methods.
(h) The depth of topsoil now on the property, the amount proposed to be removed and the amount to remain.
(i) The method of drainage to be used during the operation and after its completion and the topography of the land after the removal.
(j) The ultimate proposed use of the land after the removal of the top soil.
(k) A statement that the applicant is capable of and will furnish a performance bond in the amount of five thousand dollars ($5,000) for each acre or fraction thereof included in the permit.
The application shall be forwarded to the Municipal Engineer and Building Commissioner, and based upon their report and recommendations, a permit will be issued or denied by the Building Commissioner. The Building Commissioner may also forward the application to the Planning Commission for their report and recommendation and consideration of a Conditional Use Permit, pursuant to Chapter 1149, if the application for a permit establishes that the contemplated operations will constitute a continuous and ongoing business operation.
