1309.18 OCCUPANCY OF RESIDENTIAL BUILDING BEFORE COMPLETION PROHIBITED; LANDSCAPING REQUIRED.
(a) No person, whether owner, tenant or otherwise, shall move into, occupy or reside in any single dwelling or private residence, or any two-family dwelling or residence, or any tenement building in the Municipality which does not contain complete sanitary, heating and plumbing facilities installed in accordance with the provisions of this Building Code or which has not been completed in accordance with the provisions of this Building Code and in accordance with the terms of a building permit duly issued by the Building Commissioner.
(b) If a person, whether owner, tenant or otherwise, desires to move into, occupy or reside in any single dwelling or private residence, or any two-family dwelling or residence, prior to the installation of landscaping on the premises then before such person occupies or resides in such premises the person shall certify, in writing, on a form to be approved by the Building Commissioner that such person shall be responsible for completing the landscaping on the premises, including, but not limited to, the final grade and seeding, in accordance with the approved final grade plan, prior to the end of the growing season next following the date of occupancy.
