   1309.10 MUNICIPAL ENGINEER TO SET AND CHECK PROPERTY GRADES.
   In each case of new construction, the Building Commissioner shall designate the Municipal Engineer, or any other competent licensed engineer, to establish, set and check the grades for such property.

   1309.11 PROPERTY GRADES: CRITERIA, APPEAL.
   In establishment, setting and checking of grades in setback lines, the Municipal Engineer shall consider the natural topography of the property upon which construction is intended, the finished grades of adjoining premises, the location of public utilities in relation to the premises being improved, the contemplated use of the premises being improved, the contemplated use of the premises and the uses permitted of undeveloped adjoining properties, if any, under applicable zoning regulations. The minimum grade above the street level for single and two-family residential buildings shall be eighteen inches.
   Any person dissatisfied with the grade finally established or set by the Engineer may, within ten days, file a notice of appeal, in writing, to the Architectural Review Board of the Municipality, which shall consider the criteria required to be observed by the Engineer, as herein above set forth, accord a hearing to all interested parties, including land owners, and may affirm or modify the Engineer's determination. The order of the Board may be appealed within ten days to Council, by filing written notice with the Clerk of Council.

   1309.12 GRADING APPROVAL AND INSPECTION.
   (a)    Prior to the footers of any proposed structure being constructed, the owner or his/her agent shall file with the Building Commissioner/Service Director a certification of a registered Engineer or Surveyor certifying that the footer forms have been set in conformance with elevation and location indicated on the approved building plan for such proposed structure.
   (b)    Immediately after all construction of the foundation walls have been constructed above grade, all further construction shall cease until a certification of a registered Engineer or Surveyor is filed with the Building Inspector, certifying that the foundation walls have been constructed in conformance with the elevation and location indicated on the approved building plan for such proposed structure.
   (c)    If the work for which a building permit has been issued is not being performed in conformity with this Building Code, or with the detailed statements, plans or drawings on which such permit was issued, such work shall be suspended without delay. No person shall proceed further with such work.
   (d)    The Building Commissioner/Service Director shall notify the owner or his/her agent that the work is being constructed in violation of this Building Code and that such work be suspended without delay. A written notice of the suspension work shall be posted on the building or other structure for which the permit was issued. No person shall perform any work on or about such building or structure until such notice has been rescinded by the Building Commissioner/Service Director.

   1309.13 APPLICATION FOR SIDEWALK PERMIT.
   An application for a permit shall be required for each owner of property who shall construct or replace a sidewalk within the public right of way. The application shall contain the name and address of the applicant, a brief description of the work to be done and the approximate date of completion of the work. The application shall be filed with the Building Commissioner. (Ord. 74-29. Passed 5-20-74.)
   1309.14 SIDEWALK PERMIT FEE.
   Sidewalk and apron permit fees shall be in accordance with the fee schedule in Section l309.05.
