969.01 FLOODING AT PRIVATE RESIDENCES: USE OF VILLAGE EQUIPMENT.
   (a)    When basements in private residences are flooded in times of unusual storms and other emergencies, the Department of Public Service is authorized to use its equipment for pumping out basements in private residences, provided that the Service Director in his discretion determines:
      (1)    That such an unusual storm or emergency has caused such flooding; and
      (2)    That such equipment is not needed at that time for other Municipal purposes.
   (b)    When the equipment of the Department of Public Service is not available for pumping out basements in private residences in times of unusual storms and emergencies, the Fire Department may use its equipment for such purpose, providing the Fire Chief in his discretion makes the same determinations as are required to be made by the Service Director under the provisions of subsection (a) hereof.
   (c)    Nothing contained in this section shall require the Municipality to use its equipment for pumping out basements, and neither the Municipality nor any official or employee thereof shall be liable in damages for failure to pump out a basement or for any damage caused in performing such act.
