When a publicly owned drain tile system is installed in a street or rear yard easement, property abutting or adjoining that street or rear yard easement that has a privately owned foundation or roof drain tile system shall connect that system to the public system within one year after the public system is installed under the following circumstances:
(A) Water from the private drain tile system is being discharged onto a city boulevard or street.
(B) Water from the private drain tile system is being discharged onto property not owned by the owner of the private drain tile system.
