§ 155.10 USE REGULATIONS.
   (A)   R-1 and R-2 (Residential) Districts.
      (1)   Intent of the zoning regulations pertaining to land use within residential districts.
         (a)   It is the intent of the zoning regulations to provide for establishment of residential districts which are free from the encroachment of commercial and manufacturing uses, but which permit certain uses which are necessary within residential neighborhoods.
         (b)   It is also the intent of the zoning regulations to exclude duplex and multi-family dwellings from single-family residential districts by establishing a separate residential district for duplex and multi-family dwellings.
      (2)   Uses permitted within R-1 (Residential Single-Family) District.
         (a)   A single-family dwelling unit;
         (b)   Accessory building, restricted to the rear yard;
         (c)   Automobile parking, for residents and guests only;
         (d)   Cemetery;
         (e)   Agriculture, horticulture, nursery, but not including retail sales on the premises;
         (f)   Mobile homes or modular homes;
         (g)   Institution for children and aged, non-profit;
         (h)   Public library or museum, park, playground or play field;
         (i)   Schools; elementary, high, public or denominational;
         (j)   School nursery, kindergarten or daycare for children;
         (k)   Railroad rights-of-way, but not including shops and yards;
         (l)   Tract offices and construction buildings which shall be removed upon completion or abandonment of construction work;
         (m)   Home occupations: any occupation that is customarily carried on at the home that does not involve a structural change in the dwelling unit or in a building accessory to the dwelling unit, that does not require the employment of help other than members of the immediate family, provided however that the following uses shall not be permitted as customary home occupations: any office in which chattels or goods, wares or merchandise are commercially created, exchanged or sold; barber or beauty shops; beauty culture schools; commercial stables or kennels; doctor’s office for the treatment of patients’ and or the display of goods; and
         (n)   Animals or a private stable will be permitted on a lot having an area of more than 20,000 square feet, provided that it is located not less than 50 feet from any property line. On such lots there shall not be kept more than one horse or pony for each 10,000 square feet of lot area. Twenty-five fowl or rabbits shall be permitted for each 20,000 square feet of lot area. No such fowl or rabbits shall be housed nearer than 50 feet to a property line.
      (3)   Uses permitted within the R-2 (Residential, Multi-Family) District:
         (a)   Any use permitted in the R-1 District with single-family units;
         (b)   Duplex (two-family dwelling); and
         (c)   An apartment house, or housing project.
   (B)   C (Commercial) District.
      (1)   Intent. It is the intent of the zoning regulations to provide for the establishment of those uses within the C District which may generally be described as consisting of buying, selling or trading of commodities or services. Any use, which by nature is judged by the City Secretary to be included within the categories listed below, is excluded from any Residential District unless otherwise permitted by the zoning regulations. It is also the intent of this section to exclude from the C District those uses which require outdoor storage of goods, materials, supplies and equipment other than automobiles, parked, stored or for sale; and trucks and farm implements displayed for sale. Any use listed below which requires outdoor storage in conflict with this provision shall be restricted to the Manufacturing District.
      (2)   Uses permitted within the C District.
         (a)   Generally recognized retail businesses which supplies commodities on the premises, such as but not limited to: groceries, meats, dairy products, baked goods or other, foods, drugs, dry goods, clothing and notions or hardware;
         (b)   Personal service establishments which performs services on the premises such as but not limited to: repairs shops, tailor shops, beauty parlors or barbershops, and self-service laundries;
         (c)   Business establishments which perform services on the premises, such as, but not limited to: banks, loan companies, insurance offices and real estate offices;
         (d)   Professional services including the following: medical clinics and offices of doctors, dentists, osteopaths and similar or allied professions;
         (e)   Post offices and governmental buildings; and
         (f)   Other uses similar to the above uses.
   (C)   M (Manufacturing) District.
      (1)   Intent. It is the intent of the zoning regulations to provide for the establishment of those uses within the M District which may generally be described as consisting of manufacturing, production and assembly, and in addition, certain other uses. Any use, which is included within the categories listed below or which by nature is judged by the Building Official to be included within the categories listed below, is excluded from any Residential or Commercial District unless otherwise permitted by the zoning regulations. It is also the intent of this section to also include those uses which cause the emission of toxic, noxious or odorous matter; or smoke, dust or other air contaminants, or glare, vibration or radiation, or which require the storage, handling or transportation of explosive, inflammable or radioactive material. Any uses meeting this criteria shall be excluded from the R and C District.
      (2)   Uses permitted in the M District.
         (a)   The manufacture, compounding, processing, packaging or treatment of such products as: bakery goods, candy, cosmetics, pharmaceuticals, toiletries, food products, hardware and cutlery, machine shops;
         (b)   The manufacture, compounding, assembling or treatment of articles or merchandise from the following previously prepared materials: canvas, cloth, fibre, glass, leather, paper, plastic, sheet metal;
         (c)   Manufacture or assembly of electronic appliances, electronic instruments and devices; and
         (d)   Manufacture of sheet metal products.
