ORDINANCE ESTABLISHING COMBINED BILLING FOR VILLAGE SERVICES
WHEREAS, the Village of Matherville is authorized by the Illinois Municipal Code, 65 ILCS 5/11-125-3, to make all needful rules and regulations concerning the use of water supplied by the waterworks of the Village and for the fixing and collection of such water rates as the corporate authorities may deem necessary or expedient; and,
WHEREAS, the Illinois Municipal Code, 65 ILCS 5/11-141-7, authorizes the corporate authorities of the Village to establish charges or rates for the use and service of its sewerage system, and to make, enact, and enforce all needful rules, regulations, and ordinances for the improvement, care, and protection of its sewerage system; and,
NOW, THEREFORE, Be it Ordained by the Board of Trustees of the Village of Matherville that the Village Code of the Village of Matherville is amended as follows:
SECTION 1: VILLAGE CODE AMENDED
The Matherville Municipal Code is amended by adding the following Chapter 15 under Title I, as follows:
COMBINED BILLING FOR VILLAGE SERVICES
RENDITION OF BILLS, LATE PAYMENTS: Combined bills for water, sewer and garbage service shall be rendered monthly and shall be delinquent thirty (30) days after their rendition. In the event of failure to pay the bills within said thirty (30) days, an additional charge of ten dollars ($10.00) shall be added to the bill, as well as a delinquent penalty of up to one hundred percent (100%) of the delinquent amount.
Whenever payment is made on a combined bill for water, sewer and garbage service, the payment shall be applied first toward any outstanding fines, penalties, or late charges owed to the Village, then to the charge for garbage service, then to the charge for sewer service, and lastly to the charge for water service.”
SECTION 2: SEVERABILITY
If any provision of this Ordinance, or the application of any provision of this Ordinance, is held unconstitutional or otherwise invalid, such occurrence shall not affect other provisions of this Ordinance, or their application, that can be given effect without the unconstitutional or invalid provision or its application. Each unconstitutional or invalid provision, or application of such provision, is severable, unless otherwise provided by this Ordinance.
SECTION 3: EFFECTIVE DATE
This Ordinance shall be in full force and effect from and after its passage and approval and publication as required by law.
