(a) No employment agency shall fail or refuse to refer an individual for employment or otherwise discriminate against an individual because of race, color, religion, sex or national origin or classify or refer for employment an individual on the basis of race, color, religion, sex or national origin.

(b) Whoever violates this section is guilty of a misdemeanor of the fourth degree for a first offense; for a second or subsequent offense such person is guilty of a misdemeanor of the third degree.
