Sec. 66-3. Public improvements; petition; resolution of council.
When 51 percent of the owners of the lands liable to be assessed in any special assessment district shall petition the council for any public improvement, the council may, by majority vote, order such improvement to be made. In other cases, public improvements shall be made in the discretion of the council, upon concurrence of five of the councilmembers. When the council shall determine to make any public improvement or repairs upon petition or at the exercise of its discretion, and defray the whole or any part of the cost and expenses by special assessment, they shall so declare by resolution, stating the improvement.
