§ 116.055 SYSTEM CONSTRUCTION SCHEDULE.
   (A)   (1)   Every franchise agreement shall specify the construction schedule that will apply to any required construction, upgrade or rebuild of the cable system. Failure on the part of a franchisee to commence and diligently pursue the requirements and complete the matters set forth in its franchise agreement or to comply with the system design and construction plan submitted to the village, including by providing the equipment specified or its equivalent and by following generally accepted installation practices, except insofar as those plans or practices, if carried out, would result in construction of a system which could not meet requirements of federal, state or local law; and except for minor modifications as are typical in the industry, shall be grounds for revocation of its franchise under and pursuant to the terms of § 116.179.
      (2)   The Village Board, in its discretion, may extend the time for the completion of construction and installation for additional periods by resolution in the event a franchisee, acting in good faith, experiences delays by reason of circumstances beyond its control and requests an extension in writing.
   (B)   A franchisee’s failure to comply with provisions of the construction plan approved by the Village Board shall also be grounds for imposition of penalties pursuant to § 116.999.
