For the purposes of this chapter, the following words and phrases shall have the following meaning ascribed to them respectively.
USE. The partaking, inhaling, smoking, consumption, or ingestion of synthetic marijuana and/or a mixture of herbs and spices that is typically sprayed with a synthetic compound which includes HU-210, HU-211, JWH-018, and JWH-073.
DELIVER. The actual, constructive, or attempted transfer from one person to another of synthetic marijuana, whether or not there is an agency relationship, and includes a sale.
DISTRIBUTE. The actual, constructive, or attempted transfer from one person to another of synthetic marijuana, whether or not there is an agency relationship, and includes a sale.
SYNTHETIC MARIJUANA. Includes any material, compound, mixture or preparation of herbs and spices containing any quantity of the following substances having a similar effect of THC, including compounds of HU-210, HU-211, JWH-018, and JWH-073.
POSSESS. Means with knowledge of the presence and nature of a substance, either actually or constructively in control of a substance. A person has actual possession if he or she has the substance on his or her person or within easy reach and convenient control. A person who, although not in actual possession, has the power and intention at a given time to exercise dominion or control over the substance, either directly or through another person or persons, is in constructive possession of it.
