§ 21-207.    Conditions for Construction or Installation of Areaways and Other Openings in Sidewalk Area.
Except under extraordinary and special conditions, when the Borough Council shall determine the same to be unavoidable and necessary, it shall be unlawful for any person, firm or corporation at any time after the enactment of this ordinance, to construct or install any areaway, coal hole, cellarway, steps or similar opening in any sidewalk or in any area reserved or designated as a sidewalk area within the Borough. When the Council, following petition by the property owner for authority to construct or install any such areaway, shall determine the same to be unavoidable and necessary, the Council shall grant a permit for the same, stating in sufficient detail the regulations applicable to the location, construction, and guarding or fencing of such areaway or other opening. Such areaway or other opening shall be constructed and maintained in strict accordance with the conditions of such permit and any failure to do so shall constitute a violation of this Part.
