§ 20-108.   Dumpsters.
The Borough Manager may, in his or her sole discretion, upon good cause shown, waive the requirements of subsection (1). “Good cause” shall be shown only by physical impossibility, dangerousness or impracticality of placing a dumpster or dumpsters upon the property in question and may not be established by financial hardship. If the Borough Manager waives the requirements of subsection (1), then in that case, the owner of the property shall construct and maintain an adequate enclosure such as to prevent refuse from being scattered.
1.   No building containing six or more residential or small business units, under single ownership, and no commercial building shall be constructed or created unless adequate provision is made for the placement of an adequate compatible dumpster or dumpsters.
2.   All questions, disputes or issues in regard to the size of the dumpster(s), placement of dumpster(s), compatibility of dumpster(s) and adequacy of enclosures shall be decided by the Borough Manager.
