For the purpose of this Chapter, the following terms, phrases or words shall have the meaning ascribed to them in this Section except where the context in which the word is used clearly indicates otherwise.
ASHES - residue from the burning of wood, coal, coke or other combustible material.
BOROUGH - the Borough of Marysville, Perry County, Pennsylvania, the Mayor, Borough Manager, and the Borough Council of Marysville. [Ord. 553]
BOROUGH COLLECTOR - that individual, partnership, firm, corporation or business entity designated by the Borough Council by means of an independent contract, as the person having the exclusive right to collect refuse within the Borough, but shall not be construed as meaning that said person is an employee, official or representative of the Borough of Marysville.
COLLECTOR - a person engaged in the collection of garbage, rubbish, ashes in Marysville.
COMMERCIAL - the use of premises other than as a dwelling or small business.
DWELLING - a building used for residential purposes, except hotels, boarding and lodging houses, tourist cabins, motels.
DWELLING UNIT - one or more rooms in a dwelling which room or rooms have fixed cooking facilities arranged for occupancy by one person, two or more persons living together, or one family.
GARBAGE - putrescible animal and vegetable wastes resulting from the handling, preparation, cooking and consumption of food.
MANAGER OR BOROUGH MANAGER - the Manager of the Borough of Marysville.
OCCUPIED PROPERTY - a property which is not "vacant" as the term "vacant" is defined under this Part. [Ord. 342]
PERSON - any person, firm, partnership, association, corporation, company or organization of any kind.
REFUSE - all putrescible and nonputrescible solid wastes (excluding body wastes), including garbage, rubbish, ashes, solid industrial waste, dead animals and street cleanings.
RUBBISH - nonputrescible solid waste (excluding ashes) consisting of combustible and noncombustible wastes, such as paper, tin cans, cardboard, loose brush, yard clippings, glass, crockery, cloth and similar materials.
SMALL BUSINESS - a business establishment which produces four or less 32-gallon containers of garbage, ashes, rubbish and refuse per week.
VACANT PROPERTY - a unit of real property in which the owner or lessee has no reasonable intent of occupying same in the foreseeable future and for which a monthly Status of Occupancy/Vacancy form has been filed stating the property is vacant. In the case of leased property, in order to be determined vacant, all leases for such unit of property must be terminated and not in force and effect and the landlord shall have complied with Ord. 238, [Chapter 11] of the Borough of Marysville relative to reports required by lessor. Further, with respect to mobile homes, a vacancy shall exist during such times as the pad or mobile home is not occupied and the owner has complied with the foregoing.
