§ 15-301.   Weight Limit on Borough Streets.
   1.   It shall be unlawful for any person, firm or corporation to operate any vehicle upon the streets or roads under the jurisdiction of the Borough of Marysville if that vehicle exceeds 3 axles in weight, except as hereinafter provided.
   2.   The provisions of subsection (1) of this Section shall not apply to:
      A.   School buses.
      B.   Emergency vehicles.
      C.   All vehicles operating on Route 11 & 15 and Route 850 within the Borough of Marysville and upon any other streets or roads under the jurisdiction of the Commonwealth of Pennsylvania.
      D.   Any vehicle making local deliveries of fuel, oil, coal, firewood or LP gas to residents and businesses in the Borough of Marysville.
      E.   Any vehicle making local deliveries of items not enumerated in subsection (D) of this Section, to residences and businesses in the Borough of Marysville; provided, that such local deliveries do not exceed six in total number during any calendar year.
      F.   Any vehicle engaged in trash collection at any residence or business within the Borough of Marysville.
      G.   Any vehicle owned or used by the Borough of Marysville.
   3.   If any person, firm or corporation wishes to operate a vehicle in excess of 3 axles in weight upon the streets, roads or alleys under the jurisdiction of the Borough of Marysville, and said vehicle does not fall under the exceptions enumerated in subsection (2) of this Section, said person, firm or corporation shall apply in writing to the Borough Manager upon a form prescribed and provided by the Borough of Marysville for a permit to operate 3 axle vehicle upon Borough streets, roads and alleys. Said application shall include to the extent possible the following information:
      A.    The name, address and telephone number of applicant.
      B.   An exact description and designation, including license number of vehicle or vehicles to be used.
      C.   A description of the items or material to be transported.
      D.   The anticipated weight of said vehicle or vehicles both loaded and unloaded.
      E.   The origin of the material or items to be transported.
      F.   The destination of the material or items to be transported.
      G.   The name, address and telephone number of the owner of the vehicle or vehicles.
      H.   The name, address and telephone number of the owner of the items or material to be transported.
      I.   The name, address and telephone number of the owner of the premises where the material or items to be transported originated.
      J.   The names, address and telephone numbers of the owner of the premises where the material to be transported is destined.
      K.    The exact route, within the Borough, that the vehicle or vehicles will use.
      L.   The number, frequency and proposed dates that the vehicle will be operated within the Borough.
      M.    Such other information that the Borough Manager may deem appropriate.
   4.   Based upon application made, as set forth in subsection (3) of this Section, the Borough Manager may grant a permit for a person, firm or corporation to operate a vehicle in excess of 3 axle of weight upon the roads, streets and alleys under the jurisdiction of the Borough of Marysville upon the following conditions:
      A.   The applicant shall pay an application fee in the amount as may be fixed by Borough Council from time to time by resolution, to the Borough prior to the issuance of any permit.
      B.   The applicant shall post security, in a form approved by the Borough Solicitor, and in an amount determined by the Borough Manager, to cover the costs of repairs and restoration necessitated by the permitted movement of vehicles.
      C.   In order to determine the amount of security which may be required, the Borough Manager may employ the services of the Borough Engineer. The costs of the services of said engineer shall be the obligation of the applicant and the applicant shall pay said cost to the Borough prior to the issuance of any permit.
      D.   The permit shall designate the permitted vehicle or vehicles, the permitted weights of the vehicle or vehicles, the permitted route that the vehicle or vehicles may use, the dates and items that the vehicle or vehicles may operate, the material or items that the vehicle may transport, the premises from which the material or items may originate and the permitted destination of the material or items transported.
      E.   All operation shall be in strict conformance with the permit issued.
   5.   The Borough Manager shall deny an application when he determines that the operation of the vehicle or vehicles would create a hazardous traffic condition, or if other safety factors require denial.
   6.   Any person violating the provisions of this Section, upon conviction thereof, be sentenced to a fine of not more than $600 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 30 days.
