This is a Curfew Ordinance prescribing, in accordance with prevailing community standards, regulations for the conduct of minors on streets at night, for the protection of younger children in the Borough from each other and from other persons on the streets during nighttime hours, for the enforcement of parental control and responsibility for their children, for the protection of the public from nocturnal mischief by minors and for the reduction of the incidence of juvenile criminal activity, all for the good of minors, the furtherance of family responsibility, and the public good, safety and welfare.
A. Council finds that a curfew is a very real local need, necessary as a significant factor and tool to minimize juvenile delinquency in light of Marysville's local situation and facts: (1) the Borough is primarily a residential area, (2) there is a general community sense of the need of cessation, at the proper time, of outdoor activities of minors on the streets, reflected in the curfew hours declared by this a Part. The curfew also takes into consideration nocturnal crime and juvenile mischief that may occur after the curfew hours. (3) Council finds that Marysville Borough is not overcrowded. Recreational areas are provided in the Borough; however, these facilities are generally closed for usage at times when the activities which this Part attempts to prevent occur.
B. Council finds that parental responsibility for the whereabouts of children is the noun and, as parental control decreases the likelihood of juvenile delinquency increases, there is a need for nocturnal curfew for minors that will achieve the purposes stated in this Section.
