§ 5-102.   Additions, Insertions and Changes.
   1.   Subsection 101.1 (page 1). Insert: the Borough of Marysville.
   2.   Subsection 104.2 (page 1). Omit the entire subsection and replace with:
      "109.2. Appointment: The code official shall be appointed by the Borough Council of the Borough of Marysville; and the code official shall be an 'at will' employee."
   3.   Subsection 112.3.1 (page 5). Omit entire subsection and replace with:
      "112.3.1. Fee Schedule: A fee for each plan examination, building permit and inspection shall be paid in accordance with a schedule established from time to time by Borough Council by resolution."
   4.   Subsection 116.4 (page 6). Insert: Summary offense: $600; 30 days. [Ord. 553]
   5.   Subsection 117.2 (page 6). Insert: $100; $600. [Ord. 553]
   6.   Section 121 (page 7). Omit entire section and replace with:
      §121.0 Means of Appeal.
         121.1 Appeals: Any person shall have the right to appeal the decision of the Code Official to the Borough Council. An application for appeal shall be based on a claim that the true intent of this code or the rules legally adopted thereunder have been incorrectly interpreted, the provisions of this code do not fully apply, or an equivalent form of construction is to be used.
         121.2 Timing of Appeals: Any appeal pursuant to Subsection 121.1 shall be commenced within 60 days of the issuance of the opinion of the Code Official.
         121.3 Council Decision: Any opinion by the Code official shall be reversed only upon a simple majority vote by the Borough Council.
         121.4 Court Review: Any person, whether or not a previous party of the appeal, shall have the right to apply to the appropriate court to correct errors of law. Application for review shall be made in the manner and time required by law following the issuing of the decision by the Borough Council.
   7.   Subsection 1014.6 (page 121). Omit entire subsection and replace with:
      "1014.6 Treads and Risers: Maximum riser height shall be 7 inches (178 mm) and minimum riser height shall be 4 inches (102 mm). Minimum tread depth shall be 11 inches (279 mm), measured horizontally between the vertical planes of the foremost projection of adjacent treads and at a right angle to the tread's leading edge."
      Exceptions:
         1.   Winders in accordance with §1014.6.3.2.
         2.   Spiral stairways in accordance with §1014.6.4.3.
         3.   Circular stairways in accordance with §1014.6.5.4.
         4.   Alternating tread stairways in accordance with §1014.6.6.5.
         5.   Stairways serving as aisles in assembly seating areas where the stairway pitch or slope is set, for sightline reasons, by the slope of the adjacent seating area.
         6.   Any stairway replacing an existing stairway within a space where, because of existing construction, the pitch or slope cannot be reduced.
         7.   Existing stairways.
   8.   In occupancies in Use Group R-3 and within dwelling units in occupancies in Use Group R-2, the maximum riser height shall be 8 1/4 inches (210 mm) and the minimum tread depth shall be 9 inches (229 mm). A 1 inch (25 mm) nosing shall be provided on stairways with solid risers.
   9.   Stairways in penal facilities serving guard towers, observation stations and control rooms not more than 250 square feet (23 mm) in area shall be permitted to have risers not exceeding 8 inches (203 mm) in height and treads not less than 9 inches (229 mm) in depth.
