§ 46-55 MERIT COMMISSION’S AUTHORITY.
   (A)   The Commission shall have authority, upon the advice and recommendation of the Chief of Police, to select and appoint persons to be employed as members of the Police Department (subject to applicable state statutes), to promote members, and to issue disciplinary action to members, including unpaid suspensions for periods greater than 40 hours, demotion, and termination. Notwithstanding the foregoing, the Commission shall not have authority over the appointment or removal of members to the rank of Chief of Police or other upper-level policy making positions.
   (B)   The Chief of Police shall retain the authority to administer discipline to Police Department members up to and including 40 hours of unpaid suspension, which authority may be exercised at the Chief’s discretion and without approval of or review by the Commission.
   (C)   The Commission’s rules shall be adopted pursuant to and in accordance with I.C. 36-8-3.5-10. Proceedings related to selection and appointment, promotion, discipline, suspension, demotion, or dismissal of any member of the Police Department shall be conducted in the manner prescribed by I.C. 36-8-3.5 et seq., and other applicable state statutes.
