(a) The Mayor may resign from his or her office. A vacancy occurs in the office of Mayor by reason of his or her resignation, failure to be elected or qualify, death, permanent physical or mental disability, conviction of treason, felony or other crime involving moral turpitude, abandonment of office, removal from office or moving his or her residence from the City.

(b) If a vacancy occurs in the office of Mayor, and there remains an unexpired portion of the term of at least one year, the vacancy shall be filled by a special election which shall be held within six months after the vacancy occurs. Council shall elect one of its members as Acting Mayor who shall perform the duties and possess all rights and powers of the Mayor until a successor to fill the vacancy has been elected and has qualified.
If the unexpired portion of the term is less than one year, the vacancy shall be filled by Council electing one of its members as Acting Mayor who shall perform the duties and possess all the rights and powers of the Mayor until a Mayor is elected at the next regular election and has qualified. When the unexpired term or portion is less than one year, there shall be no special election under this section.
