(A) The City Administrator may authorize the use of any city property, and the use of the City of Martindale, Texas name, trademark or logo for commercial filming. The City Administrator may impose conditions and restrictions on commercial filming activities involving city property in the interest of public health, safety and welfare. The conditions and restrictions will include those contained in this chapter, those specified in the permit, and those communicated in writing to the producer. A security or damage deposit may be required based on the type of production activity.
(B) The City Administrator has full authority over the hours of filming, the location of filming, and the manner of use of city property in the course of commercial filming. The City Administrator has the full and absolute right to prohibit commercial filming or to order cessation of commercial filming involving city property, if determined to be detrimental to the public health, safety and welfare.
(C) For commercial filming using the city as a core location for filming, the producer will pay the city a fee based on the production costs of filming as follows.

(D) For commercial filming that does not use the city as a core location for filming, the producer shall pay fees to the city for the use of city property as follows.
