The provisions of this chapter will apply to any person that provides utility service in the city and installs, places, operates or maintains facilities in, on, over or under the public rights-of-way. If such a person has a current franchise agreement with the city, however, the provisions of that agreement will control over any conflicting provisions in this chapter.
