§ 95.999 PENALTY.
   (A)   In lieu of the foregoing abatement procedures, the city may elect to treat an unabated nuisance as a violation of this chapter, punishable as provided in § 10.999(B) of this code of ordinances.

   (B)   In addition, the creation or maintenance of a nuisance is a municipal infraction, as defined by § 10.999(B) of this chapter, and is punishable by a civil penalty of not more than $750 for the first offense and not to exceed $1,000 for each repeat offense.
