§ 33.003 ASSISTANT CHIEF OF POLICE; APPOINTMENT; QUALIFICATIONS; REMOVAL.
   (A)   The Assistant Chief of Police shall be appointed by the Chief of Police from the qualified members of the Police Department from the standing civil service promotion list and shall have not less than five years continuous service and shall be subject to competitive tests or examinations under the Civil Service Commission.

   (B)   The Assistant Chief of Police shall hold his or her position at the pleasure of the Chief of Police and may be removed at any time by written order, stating the reasons therefor and filed with the City Clerk. There shall be no appeal from such removal order.

   (C)   The Assistant Police Chief shall be second in rank and position in the Police Department and, in the absence of the Chief of Police, shall be in full charge and control of the Police Department and shall perform all functions and duties of the Chief of Police and be responsible to the Chief of Police for the performance of his or her duties.
