§ 31.003 CITY ADMINISTRATOR.
   (A)   Statement of intent.
      (1)   It is the purpose and intent of the City Council to establish the position of City Administrator and to empower that position with the duties and responsibilities of overall management, direction and co-ordination of all city services, while retaining in the City Council its role as a policy making body; in enacting, implementing or modifying recommendations of the City Administrator; and in fulfilling its legal obligations.
      (2)   The Mayor shall continue to be the Chief Executive Officer of the city, shall, without additional compensation, act as the City Administrator when the office is vacant and shall continue his or her other duties as set forth in the Code of Iowa and the code of ordinances, except as modified hereinafter.
   (B)   Position established. The position of City Administrator is hereby established. The City Administrator shall be appointed by the City Council and shall serve at the pleasure of the Council. The City Administrator shall be qualified by education and experience as shall be established by the Council. As a minimum qualification, the City Administrator shall have graduated from a college or university of recognized standing with a Masters degree in Public Administration or a closely related field. In addition to this educational requirement, the City Administrator shall have extensive experience as a City Manager or City Administrator, which experience is preferably in the state. In lieu of the above experience requirement, the City Administrator can have any equivalent combination of experience and training, which provides the knowledge, skills and abilities necessary to perform the work.
   (C)   Duties. The City Administrator shall:
      (1)   Be the Chief Administrative Officer of the city;
      (2)   Supervise enforcement and execution of all laws, rules, and regulations of the city and the state and United States of America as they pertain to this city;
      (3)   Carry out the policies of the City Council and attend all meetings of the City Council unless excused by the Mayor or by a majority of the Council;
      (4)   Make studies of city organization, procedures, policies and facilities and recommend fiscal and other policies to the Mayor and City Council as may be expedient for efficient operation of the city;
      (5)   Co-ordinate and direct all city services provided through the various departments; supervise the overall activities of said departments and delegate appropriate duties and responsibilities to the supervisors of said departments;
      (6)   Appoint, discipline and discharge for proper cause, subject to Council approval, and in accordance with the personnel policies of the city, the department heads of the city, except where such powers are delegated by state law. Supervise, direct and evaluate the department heads in accordance with the personnel policies of the city; appoint such assistants as may be authorized by the Council and direct their activities;
      (7)   Plan and supervise with the department heads the construction, improvement, repair, maintenance and management of all city property, capital improvements, and the undertakings of the city, except those managed by the Utility Board of Water Works Trustees, the Board of Library Trustees, the Board of Community Center Trustees and the Coliseum Commission;
      (8)   Co-operate with any other agencies or units of government or Boards of Trustees;
      (9)   Investigate the offices and conduct of any city department, agency, officer or employee and compel the production of records and the attendance of witnesses;
      (10)   Establish planning and goal setting procedures for the city;
      (11)   Co-ordinate all activities and interactions of the Council and the departments of the city;
      (12)   Assume such other duties as directed by the Council of the whole;
      (13)   Devote full-time to performances of duties as City Administrator and shall not engage in other employment, self-employment or other office except with the approval by a majority vote of the Council;
      (14)   As a condition of employment, reside within the corporate limits of the city; and
      (15)   Not hold any position as officer or director of, nor hold ownership of more than 5% of outstanding stock in any for-profit corporation conducting business in or with the city.
