(A) Membership.
(1) The County Unsafe Building Board is hereby designated the hearing authority as outlined in I.C. 36-7-9 et seq. The Unsafe Building Board will hear cases in accordance with I.C. 36-7-9 et seq.
(2) Membership of the Unsafe Building Board will consist of nine members. Each member must be a resident of the county and be appointed as follows.
(a) Each of the following towns in the county may appoint a member to the Unsafe Board. The towns include: Argos, Bourbon, Bremen, Culver, Plymouth and LaPaz.
(b) The County Commissioners will appoint one member of the Board.
(c) The County Council will appoint one member to the Board.
(d) One social services advocate will be appointed to the Board by the County Commissioners.
(3) Neither the Building Commissioner nor his or her staff or his or her designee may be a member of the Unsafe Building Board.
(B) Organization.
(1) Quorum. A quorum consists of a majority of the entire membership of the Unsafe Building Board, who are qualified to vote.
(2) Organization; President and Vice President. At the first regular meeting in each year, the Unsafe Building Board shall elect from its members a President and a Vice President. The Vice President may act as President of the Unsafe Building Board during the absence or disability of the President.
(3) Organization; Secretary. The Unsafe Building Board may appoint and fix the duties of a secretary, who is not required to be a member of the Board.
(4) Organization; regular meeting and minutes. The Unsafe Building Board shall fix the time for holding regular meetings as necessary. The Unsafe Building Board shall keep minutes of its meetings, The minutes of the Unsafe Building Board meetings and all records shall be filed in the office of the Building Commissioner and are public records.
