(A) Pursuant to the authority of and subject to I.C. 36-8-16.7-32, an emergency telephone system fee is hereby established to provide for the funding of an enhanced emergency telephone system to serve the citizens of the county. This fee shall be collected from the telephone services users of the county and administered in accordance with the terms of this section.
(B) A monthly fee of $1.53 per telephone access line will be collected by the telephone service supplier to pay to the county for the personnel costs, lease, purchase or maintenance of enhanced emergency telephone equipment (E-9-1-1), including necessary computer hardware, software and data base provisioning; and the rates charged by the service suppliers’ enhanced emergency telephone system network services.
(C) The service supplier shall be entitled to retain an administrative fee of 3% of the monthly fees collected as compensation for collecting the fees.
(D) All monthly fees collected, except for the 3% administration fees, shall be remitted to the County Treasurer within ten days after the last day of the calendar-year quarter. With the fee remittal, the service supplier shall provide a fee collection report to the County Auditor on a form provided by said Auditor.
(E) The County Treasurer shall deposit the remitted fees in a separate Fund named the “County Emergency Telephone System Fund.” The County Treasurer may invest monies in the Fund in the same manner that other monies of the county are invested.
(F) During January of each year, each service supplier that collects the enhanced emergency telephone system fee for the county shall provide a delinquent fee report to the county. The report shall list the name, address and amount due for each service user who is two or more months delinquent in
paying the fee.
(G) This section shall be construed in accordance with I.C. 36-8-16.7-32, as amended.
(H) Each service supplier shall commence collecting the enhanced emergency telephone system fee from its service users in the month of September, 1991.
