§ 33.060 HEALTH DEPARTMENT COLLECTION OF FEES; SPECIFIC FEES.
   (A)   Definitions. For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      BOARD OF HEALTH. The County Board of Health as provided for in I.C. 16-20-2-1 et seq.
      HEALTH DEPARTMENT. The County Health Department.
      PERSON. Any association, company, corporation, firm, individual or partnership.
   (B)   Collection of fees. The Health Department shall collect the fees for all services it provides in accordance with this section.
   (C)   Fees for services. The Board of Health shall charge a fee for providing any person with the services listed in the fee schedule of this section.
   (D)   Collection of fees, accounting and disposition.
      (1)   Collection of fees. The Health Department shall collect the fees established by this section in accordance with division (E) below.
      (2)   Accounting for fees. All fees collected by the Health Department shall be accounted for in detail for each program service area.
      (3)   Disposition of fees. All fees collected by the Health Department pursuant to this section shall be transferred to the County Health Fund.
      (4)   Fees for other county health jurisdictions. Fees collected for health services and records provided to persons in other county health jurisdictions and involving payment from county tax revenues shall be collected in accordance with agreements entered into pursuant to I.C. 16-20-1-8.
   (E)   Fee schedule. The following fee schedule is established and approved for services and records provided by the Health Department. (A list does not necessarily indicate the service is currently provided.)
      (1)   Food protection program. These fees do not include establishments that have a complete food inspections by other recognized state or federal agencies, and are not inspected by this Department. Establishments opening in mid-year pays either the full amount or one-half the price for six months or less.

      (5)   County Morgue fees.
         (a)   As long as storage of a body is in the County Morgue for the funeral homes in the county and for a county contiguous to the county, the fees for storage will be waived.
         (b)   The County Coroner has entered into mutual aid agreements with contiguous counties which is the basis for the waiver of said fees.

      (6)   General.
         (a)   When possible, county government and public schools will not be charged for services; however, actual out of budget cost for the Health Department or large or continuous request for services may result in fees.

   (F)   Maximum fee schedule.
      (1)   The fees set forth in this section are maximum fees.
      (2)   Specific fees charged shall be determined by and limited in accordance with any applicable state and federal laws, rules and regulations pertaining thereto. In addition, specific rates charged shall be governed by any applicable sliding fee scales adopted by the Board of Health which are based upon the person’s financial ability to pay.
