§ 33.044 CUMULATIVE CAPITAL PROJECTS ENABLING FUND.
   (A)   There is hereby created the County Cumulative Capital Projects Enabling Fund, (“Fund”) into which, in the discretion of the Board of Commissioners, there shall be diverted each year from the County General Fund, an amount of funds found necessary by said Board of Commissioners. In addition thereto, certain miscellaneous revenues, CAGIT funds, interest earned and proceeds from the sale of the hospital may also be put into said Fund, as determined by the County Council.
   (B)   The funds so accumulated into this Fund will be used solely for the construction and/or renovation of the County Jail and any other structures owned by the county as deemed necessary by the Board of Commissioners, and that an appropriation be established, so that all expenditures from said Fund shall receive the approval of the County Council. Said Fund shall be perpetual until terminated by subsequent action of the Board of Commissioners.
   (C)   Upon termination of the Fund by subsequent action of the Board of Commissioners, any funds remaining in said Fund shall, upon such termination, be transferred to the General Fund.
