(A) No person whether or not required to be licensed under the provisions of this subchapter, shall occupy or use the public sidewalks, streets, alleys or other public places while engaged in the pursuit or business of hawker, peddler, itinerant merchant or transient vendor of merchandise; excepting, however, unless authorized pursuant to the provisions of § 97.021(E).
(B) Notwithstanding any other provisions of this chapter, no license shall be issued to any person for a fixed point or location unless the applicant is the owner or lessee of said location, and provides written evidence thereof with the application for license.
(C) Transient vendors shall only be authorized to sell merchandise, food or non-alcoholic beverages on a seasonal basis not to exceed six consecutive months. Transient vendors shall not sell merchandise, food, or non-alcoholic beverages out of a moving vehicle, but shall conduct business out of a permanent or stationary structure.
