§ 97.041 RESTORATION OF SURFACE; REMEDY OF INEQUALITIES IN SURFACE.
   (A)   The person making sewer or drain connections or taking up, laying, relaying or connecting any gas or water pipe or main under the permit shall leave the public streets in as good condition as before work was commenced and in a condition satisfactory to the Commissioner of Streets and Public Improvements. He shall level off the surface and when possible, water settle the fill and if not, then thoroughly tamp the fill so as to avoid settling.
   (B)   Such person shall also at any time within one year after the date of obtaining permit to do such work, upon receiving written notification from the Commissioner, remedy any inequality in the surface of the street at the place where such excavation was made and conform with the directions of the Commissioner in relation thereto. In the event of any person refusing to obey the directions of the Commissioner in regard thereto, it shall be the duty of the Commissioner to immediately notify the Mayor, and the Mayor shall thereupon refuse to issue any more permits for street work or plumbing until such notice of the Commissioner shall have been complied with; and the Commissioner shall cause necessary repairs to be made in the street and report to the Council the cost of said repairs and suit shall be brought upon the bond as provided herein for damages and the amount of the cost of such repairs.
