§ 31.10 CITY CLERK.
   (A)   Creation of office. There is hereby created and established the office of City Clerk.
   (B)   Election. The Clerk shall be elected at the first regular meeting of the City Council in May of each year or as near thereafter as may be practicable.
   (C)   Bond. The Clerk, before entering upon the duties of his office shall execute a bond to the city, in the penal sum of $6,000, with such surety as the Council may approve, conditioned for the faithful performance of the duties of his office as Clerk and ex-officio City Collector, and the payment of all moneys that may be received by him according to law, the provisions of this code and any applicable ordinances of the city.
   (D)   Clerk as City Collector. 
      (1)   The Clerk shall be ex-officio City Collector and shall perform all duties of the Collector as fixed by law, the provisions of this code or any applicable ordinances of the city, in addition to his duties as Clerk.
      (2)   As Collector, the Clerk shall preserve all warrants which are returned to his hands; he shall keep separate books and accounts showing accurately all money received by him and from whom and on what account received and when turned over to the City Treasurer. Such warrants, books and papers pertaining to his office shall, at all times, be open to inspection of and subject to the examination of the Mayor or any Commissioner.
      (3)   As Collector, the Clerk shall, from time to time, as required by the Commissioner of Accounts and Finances, submit to the Council a statement of moneys collected by him, the particular warrant, special assessment or account on which collected, and balance of moneys uncollected on all warrants in his hands and the amounts turned over by him each week to the Treasurer.
   (E)   Duties. The Clerk shall perform all the duties imposed by statute and shall in addition thereto, perform the following duties:
      (1)    The Clerk shall keep in a suitable book to be styled “Records of the Council” a full and faithful record of all proceedings of the Council, which records of such proceedings shall be typewritten. To aid in the preparation of minutes for any regular or special meeting, open to the public, the Clerk in his or her discretion may take and keep tape-recordings of the meetings despite the fact that such tapes may be subject to distortion, gaps and other imperfections. Such tapes, if made, shall be maintained until the minutes of such meeting open to the public are approved. After such meeting minutes are approved, such tapes may be destroyed by the Clerk. The foregoing shall not limit the ability of a member of the public to record open proceedings by tape, film or other means as generally authorized by § 2.05 of the Open Meetings Act. The Clerk shall keep a verbatim record of all closed meetings in the form of an audio or video recording in compliance with § 2.06 of the Open Meetings Act and shall keep such recordings until approved by destruction in compliance with said § 2.06.
      (2)   The Clerk shall issue notices to the members of the Council when directed by that body, to the several Commissioners and members of any committee created by the Council and to all persons whose attendance is required before the Council or Commissioners, when directed by any Commissioner and shall issue notices of special meetings.
      (3)   The Clerk shall attest all licenses granted by the Mayor or Council under this code or any applicable ordinances of the city.
      (4)   The Clerk shall, without delay, deliver to the Mayor, Commissioners or other officers of the city, all resolutions and communications referred to such Mayor, Commissioners or other officers.
      (5)   The Clerk shall perform such other duties usually incident to the office of Clerk as may from time to time be required of him by the Council, Mayor or Commissioners.
