§ 50.01 DEFINITIONS.
   Words and phrases used in this chapter shall have the meaning or definition as contained in Section 3 of the Environmental Protection Act (ILCS Ch. 415, Act 5, § 1, et seq.), unless the context otherwise clearly requires.
   GARBAGE. Waste resulting from the handling, processing, preparation, cooking and consumption of food, and wastes from the handling, processing, storage and sale of produce.
   WASTE. Any garbage, sludge from a waste treatment plant, water supply treatment plant, or air pollution control facility or other discarded material, including solid, liquid, semi-solid or contained gaseous material resulting from industrial, commercial, mining and agricultural operations, and from community activities, but does not include solid or dissolved material in domestic sewage, or solid or dissolved materials in irrigation return flows or industrial discharges which are point sources subject to permits under Section 402 of the Clean Water Act (33 USC 142) or sources, special nuclear, or by-product materials as defined by the Atomic Energy Act of 1954, as amended (68 Stat. 921) (42 USC 2011 et seq.) or any solid or dissolved material from any facility subject to the Federal Surface Mining Control and Reclamation Act of 1977 (P.L. 95-87) (30 USC 1201 et seq.) or the rules and regulations thereunder or any law or rule or regulation adopted by the state pursuant thereto.
   REFUSE. Shall mean waste.
   LANDSCAPE WASTE. All accumulations of grass or shrubbery cuttings, leaves, tree limbs and other materials accumulated as the result of the care of lawns, shrubbery, vines and trees.
   MUNICIPAL WASTE. Garbage, general household and commercial waste, landscape waste and construction or demolition debris.
   FLUID. Material or substance which flows or moves whether in a semi-solid, liquid, sludge, gas or any other form or state.
   DISPOSAL. The discharge, deposit, injection, dumping, spilling, leaking or placing of any waste or hazardous waste into or on any land or water or into any well so that such waste or hazardous waste or any constituent thereof may enter the environment or be emitted into the air or discharge into any waters, including ground waters.
   ASHES. The waste product of combustion of any material.
   PERSON. Any individual, partnership, copartnership, firm, company, corporation, association, joint stock company, trust, estate, political subdivision, state agency or any other legal entity, or their legal representative, agent or assigns.
   OPEN BURNING. The combustion of any matter in the open or in an open dump.
   OPEN DUMPING. The consolidation of refuse from one or more sources at a disposal site that does not fulfill the requirements of a sanitary landfill.
