§ 135.06 RAFFLE REGULATION AND LICENSE.
   (A)   Definitions. All definitions contained in the Illinois Raffles Act shall apply to this chapter, and in case of any conflict between the provisions of this chapter and the provisions of the Illinois Raffles Act, ILCS Ch. 230, Act 15, §§ 0.01 et seq., as amended, shall control.
   (B)   License required. No person, firm or corporation or other entity shall conduct a raffle without first having obtained a license for such pursuant to this chapter. Any licenses issued pursuant to this chapter shall be valid for one raffle or for a specified number of raffles to be conducted during a specified period. No raffle license shall extend beyond one year. No license shall be required for a raffle which does not require a license under the Raffles Act to be lawful.
   (C)   Eligibility.
      (1)   Licenses shall be issued only to bona fide religious, charitable, labor, business, fraternal, educational or veterans’ organizations as defined by the Raffles Act.
      (2)   The following are ineligible for any license under this chapter:
         (a)   Any person who has been convicted of a felony;
         (b)   Any person who is or has been a professional gambler or gambling promoter;
         (c)   Any person who is not of good moral character;
         (d)   Any firm or corporation in which a person defined in divisions (a), (b), or (c) above has a proprietary, equitable or credit interest, or in which such a person is active or employed;
         (e)   Any organization in which a person defined in divisions (a), (b), or (c) above is an officer, director or employee, whether compensated or not; or
         (f)   Any organization in which a person defined in divisions (a), (b), or (c) above is to participate in the management or operation of a raffle as defined in the Illinois Raffles Act.
   (D)   Applications. Applications shall be made in writing on the form prescribed by the city and filed with the City Clerk.
   (E)   License fee. There is no application fee for a license to conduct a raffle.
   (F)   Records.
      (1)   Each organization licensed to conduct a raffle shall keep such records as required under the Raffles Act.
      (2)   Each organization licensed to conduct raffles shall report in writing within 30 days after the conclusion of each raffle to its membership, its gross receipts, expenses and net proceeds from raffles, and the distribution of net proceeds itemized as required in the Illinois Raffles Act. Where an organization is licensed to conduct more than one raffle, the report may be filed within 30 days after the conclusion of the last raffle drawing.
      (3)   Records required by this section shall be preserved three years, and organizations shall make available their records relating to operation of raffles for public inspection at reasonable times and places.
   (G)   Repealer. All ordinances or parts of ordinances in conflict herewith are hereby repealed except as so repealed shall be and remain in full force and effect.
   (H)   Validity of license. Each such license shall be valid for one raffle or for a specified number of raffles during a specified period not to exceed one year, and may be suspended or revoked by the corporate authorities in the event of violation of the terms of this chapter or of any applicable state law.
   (I)   Manager and bond. All operations of and conduct of raffles shall be under the supervision of a single raffles manager designated by the organization. The manager or operator of the raffle must be a bona fide member of the organization holding the license for such a raffle and may not receive any remuneration or profit for participating in the management or operation of the raffle. The manager shall provide a bond in an amount set by the organization holding the license unless said organization waives any bond requirement as authorized under the Raffles Act.
   (J)   Suspension/revocation. Any license granted under this chapter may be suspended or revoked by the city at any time it appears that the proposed or actual operation of the raffle will be or is such as to constitute a public nuisance or to endanger the public peace, health, safety, or welfare. Any license granted under this chapter may be suspended or revoked in whole or in part at any time that the raffle is conducted contrary to the license or to any state or city law, or when such raffle or portion thereof is conducted so as to constitute a public nuisance or to disturb the peace, health, safety or welfare. Suspension or revocation shall become effective immediately. It shall be a violation for any person to operate, engage or participate in, except as a patron, any raffle which license has been suspended or revoked.
