§ 122.04 APPLICATION CRITERIA.
   (A)   General requirements. At a minimum, the application shall include the application fee of $25, a certificate from LaSalle County Health Department, and a drawing to scale illustrating the tables, seating, and garbage receptacle locations. The drawing shall also illustrate the entire sidewalk area showing all existing light posts, signs and other permanent improvements. The location of improvements and personal property shall be located directly in front of the permit holder's property. The sidewalk café area shall allow no less than an eight foot unobstructed pedestrian walkway from that point of the sidewalk where car bumpers no longer encroach to the closest piece of sidewalk café furniture. The application shall provide a statement for how garbage control will be managed. The application shall identify what beverage products will be served.
   (B)   Insurance requirement. Each applicant for a permit shall furnish a certificate of insurance showing commercial general liability insurance of not less than $100,000 per person, $300,000 per occurrence. As a portion of the sidewalk café is on a public right-of-way, the city shall be named as an additional insured on a primary, noncontributory basis for any liability arising from the operations of a sidewalk café. The policy of insurance shall contain the provision requiring notice to the city prior to any cancellation. The permit holder shall indemnify, defend and hold harmless the city from any loss that results from the permit issuance.
   (C)   Furniture requirement. All tables and chairs shall be black in color and cast in either aluminum or wrought iron. Tables shall measure no more than 46 inches in diameter that their widest points. Each table shall not seat more than four chairs. The number of tables is to be determined according to the store frontage but not to exceed four tables in total. Any umbrellas shall be placed directly in the middle of the table and when opened shall be straight up and shall be weighted down in a proper stand directly under the middle of the table. All umbrellas shall be closed and/or removed when the sidewalk café is not open for business. Security cables are only to be used when the sidewalk café is closed, and any security cable shall be connected to one table and its respective four chairs and shall not be connected to any other table, chairs, trees, planters, store front, or garbage receptacle.
