§ 33.81 CHIEF, CAPTAIN, LIEUTENANT, AND PART TIME OFFICERS.
   (A)   The Chief of Police shall be appointed and subject to discipline by the City Council. The Captain shall be appointed by the Chief of Police subject to the approval of the Commissioner of Public Health and Safety. The Captain is subject to discipline and removal by the Chief subject to the approval of the Commissioner of Public Health and Safety. The position of Lieutenant shall be appointed by the Chief and Commissioner of Public Health and Safety from the top three candidates identified from a list provided by the Board of Police Commissioners. Up to two Lieutenants may be appointed. The Lieutenant shall be subject to discipline by the Board of Police Commissioners. The position of Sergeant shall be appointed by Chief and Commissioner of Public Health and Safety, from the top three candidates identified from a list provided by the Board of Police Commissioners. Up to two Sergeants may be appointed. The Sergeant shall be subject to discipline by the Board of Police Commissioners unless they are members of a collective bargaining unit with an agreement that states otherwise. A Sergeant may be a member of a collective bargaining unit due to the lack of supervisory duties held by the more superior officers identified above. If an active member of the Police Department is appointed Chief of Police, Captain or Lieutenant prior to being eligible to retire on pension and thereafter loses the appointment as Chief of Police, Captain or Lieutenant, such person shall be considered as on furlough from the rank they held immediately prior to appointment as Chief and their position shall revert to and be established in such prior rank and thereafter be entitled to all the benefits and emoluments of such prior rank without regard as to whether a vacancy then exists in such rank.
   (B)   Part time officers employed by the city shall not be subject to Police Commission rules.
