(A) It shall be unlawful to build or light any open fire or conduct burning within ten feet of a structure, vehicle, trailer or any combustible material. Any open fire or burning shall be at least two feet away from any public street, sidewalk, and concrete curb or guttering. Open fires and burning within the city limits are permitted for the following purposes:
(1) Recreational campfires. Recreational campfires (including bonfires) of less than three feet in diameter, burning untreated wood only, within a contained area, from the hours of 10:00 a.m. until 10:00 p.m. on Sunday through Thursday, and from the hours of 10:00 a.m. on Friday and Saturday through 1:00 a.m. the following day.
(2) Festive/ceremonial burnings. Festive and/or ceremonial burnings in excess of three feet in diameter can be allowed through a permit issued by City Hall. The Police Chief, the Fire Chief, or his or her designee shall review the permit request and may approve a permit with certain conditions, or deny the request on the grounds of public safety when appropriate. Permitted burning hours shall be from the hours of 10:00 a.m. until 10:00 p.m. on Sunday through Thursday, and from the hours of 10:00 a.m. on Friday and Saturday through 1:00 a.m. the following day.
(3) Cooking. Open fires used for cooking food at public or private gatherings are allowed, provided that such fires are exclusively for said purposes between the hours of 7:00 a.m. until 10:00 p.m. on Sunday through Thursday, and from the hours of 10:00 a.m. on Friday and Saturday through 1:00 a.m .the following day.
(4) City staff attended. Fires started and attended by the personnel of the city’s Fire Protection District.
(B) All fires must be outside any building and enclosed in a container, pit, or other manner. All fires must be maintained by a person 18 years or older present at all times of burning, and must be completely extinguished beyond permitted burning times.
