10-2-35: SOLICITATION AND CONSPIRACY TO COMMIT OFFENSE:
   A.   Solicitation To Commit Offense: A person commits solicitation when, with intent that an offense be committed, he commands, encourages or requests another to commit that offense.
   B.   Conspiracy To Commit Offense: A person commits conspiracy when, with intent that an offense be committed, he agrees with another to the commission of that offense. No person may be convicted of conspiracy to commit an offense unless an act in furtherance of such agreement is alleged and proved to have been committed by him or by a coconspirator.
   C.   Affirmative Defense: It shall be a defense to a charge of solicitation or conspiracy that if the criminal objectives were achieved, the accused would not be guilty of the offense. (Ord. 153, 8-21-1972)
