10-2-1: DEFINITIONS:
ACT: A failure or omission to take action.
AIR RIFLE: Any air gun, air pistol, spring gun, spring pistol, BB gun or pellet gun which impels a pellet constructed of hard plastic, steel, lead, stone or other hard materials with force that reasonably is expected to cause bodily harm or property damage.
ANOTHER: A person or persons as defined in this code other than the offender.
ASSAULT: When, without lawful authority, a person engages in conduct which places another in reasonable apprehension of receiving a battery.
BATTERY: If a person intentionally or knowingly, without legal justification and by any means: a) causes bodily harm to an individual, or b) makes physical contact of an insulting or provoking nature with an individual.
CIVIL EMERGENCY: A. A riot or unlawful assembly characterized by the use of actual force or violence or any threat to use force if accompanied by immediate power to execute by three (3) or more persons acting together without authority of law; or
   B.   Any natural disaster or manmade calamity including flood, conflagration, cyclone, tornado, earthquake or explosion within the corporate limits of the city resulting in the death or injury of persons or the destruction of property to such an extent that extraordinary measures must be taken to protect the public health, safety and welfare.
CURFEW: A prohibition against any person walking, running, loitering, standing or motoring upon any alley, street, highway, public property or vacant premises within the corporate limits of the city, excepting officials of any governmental unit and persons officially designated to duty with reference to said civil emergency.
POLICE OFFICER: Any person who, by virtue of his office or public employment, is vested by law with a duty to maintain public order or to make arrests for offenses, whether that duty extends to all offenses or is limited to specific offenses.
PUBLIC EMPLOYEE: A person, other than a public officer, who is authorized to perform any official function on behalf of, and is paid by, the city or any of its subdivisions or agencies.
PUBLIC OFFICER: A person who is elected to office pursuant to a statute or ordinance, or who is appointed to an office which is established, and the qualifications and duties of which are prescribed, by statute or ordinance, to discharge a public duty for the city, or any of its subdivisions or agencies.
REASONABLE BELIEF OR REASONABLY BELIEVES: The person concerned, acting as a reasonable man, believes that the described facts exist. (Ord. 153, 8-21-1972)
