9-1-6: CONSTRUCTION REQUIREMENTS:
   A.   Permit Required:
      1.   Street Openings: No public street may be cut or opened except by an approved contractor who shall first have obtained a permit for same.
   B.   Obtaining Permits; Cash Or Surety Bond:
      1.   Franchise Utility Companies And Sewer Contractors: The permit for said cut or opening shall be obtained from the city, after first having paid a bond for street opening, or cut, in the amount as set forth below. Said bond shall cover the cost of inspection. A permit may be denied to any contractor who has previously failed to comply with this code.
      2.   Maintenance And Excavation Contractors; Bond: Maintenance and excavation opening permit for replacement or renewal/removal of facilities:
         a.   In order to obtain said permit, said person, firm, or corporation shall file with the city clerk a written application therefor, which application shall set forth the type of hole, digging or excavating proposed to be done, giving the approximate length and depth thereof, and when same shall be done. Whereupon, the city clerk shall refer said application to the superintendent of the streets, and if said superintendent approves said application, the city clerk shall thereupon, issue said permit; provided, however, that before said permit is issued the said applicant shall file with the city clerk a cash or surety bond in the sum of five hundred dollars ($500.00), which bond shall be for the purpose of guaranteeing to the city that said applicant replace, cover and surface said hole, digging or excavating, in the same manner and in as good condition as said street or public property was in before said work was done, and shall be retained by the city as damages and for the purpose of paying for the replacement of said work in the proper manner. Said applicant shall also be responsible for replacement costs exceeding the five hundred dollar ($500.00) bond. The city shall have sixty (60) days from completion of said work before the city shall be required to approve or disapprove same.
   C.   Compliance With Specifications Of City Council: All street and sidewalk pavements shall be made in conformity with specifications laid down or approved from time to time by the city council. (Ord. 550, 2-22-1999)
